The consumer representative suggested establishing a third-party appraisal agency. Consumers who are not responsible for the burden of proof from Chengdu should not be allowed to buy a car that Zhang Yi recently purchased. The draft of the Opinions stipulates that within the warranty period of the Three Guarantees, there will be product quality problems for household automotive products. Consumers will apply for free repairs (including working hours and material costs) at designated or agreed repair shops on the basis of three-guarantee certificates. However, there is no clear rule on how to determine whether the product has quality problems.

In this regard, Zhang Yi suggested that consumers should not be allowed to prove that the product has quality problems. If the manufacturer wants to be exempt, it must provide evidence that the vehicle fault is not a product quality issue. "In addition, I propose to establish an authoritative third-party accreditation body and openly test the cost."

The proposal to establish a third-party accreditation body was endorsed by all representatives present. Han Feng, the dealer's representative, said that at present, there is no independent testing agency to assess the quality of the vehicle. The criteria for returning goods are difficult to define. It is hoped that a third-party appraisal agency will be established to save the public from wrangling.

Chen Xingbin from Dongfeng Motor Co., Ltd. further suggested linking the third-party appraisal agency with the judicial appraisal agency to avoid increasing the time and cost of two or more appraisals.

Representatives of dealers believe that there is no operability in the relevant provisions of the return policy. According to the Opinions, the cumulative time for repairs due to product quality issues must not exceed 35 days within the validity period of the entire vehicle three packs, and if it exceeds 35 days, consumers can use the three packs of evidence. Repair records, car invoices, the seller is responsible for replacing the same brand with the entire vehicle model.

This rule was opposed by distributors and manufacturer representatives.

Zhao Xinghui, a representative from Volkswagen (China) Investment Co., Ltd., said: “We cannot prepare all auto parts in advance. Some of the parts that need to be imported can only be ordered overseas when consumers request repairs. There are a few months or more for more than two months for all kinds of formalities. We may not be able to do this on the 35th.

Zhao Xinghui suggested that manufacturers be allowed to file a special part at the AQSIQ. If vehicle maintenance requires the use of this part, the repair time limit can exceed the 35-day limit.

The return policy in the consultation draft is a hot spot in the society.

This provision is said to have the significance of ending the history of automotive products that will only be repaired and returned. However, dealer representatives have questioned the operability of returns.

Ye Yongqing, a dealer representative from Lixingxing (Beijing) Automobile Co., Ltd., said: “Sometimes, we want to give the consumers a refund and they will not return. For instance, if Beijing restricts the license plate number, we cannot shake it and we can’t give it to consumers. The car is returned to the car, and the car is a very special commodity. The return of the car also involves purchase tax and many other issues."

"In addition, the cars that are returned are too wasteful to be discarded. Dealers will choose to repair them as used cars for sale." Ye Yongqing said, "But now many dealers do not have the qualifications to sell second-hand cars. We need the industry and commerce departments to cooperate. The consumer representative hopes to extend the warranty period and return time of the three guarantees. “I hope to extend the validity of the auto three packs,” said Liu Fang, a consumer representative.

The stipulation of the Exposure Draft on the validity of the Three Guarantees is that the validity period of the vehicle three guarantees shall not be less than 2 years or 40,000 kilometers, whichever comes first. However, the Opinions also propose to encourage automakers to set a longer three-pack validity period.

Liu Fang said that the auto three bags of the Kia Motors in the United States are valid for five years or 100,000 kilometers, and the public in the United States is 80,000 kilometers in four years.

A dealer representative suggested that the restrictions on the validity period of the Three Guarantees be abolished. At present, the majority of automotive companies in the market have a validity period of three guarantees that are not lower than the requirements of the draft, and some are even higher. Therefore, it is better to not make explicit provisions on this to prevent certain companies from reducing the original warranty period after the introduction of regulations. .

The draft of the consultation also stipulates that within 30 days after the sale of a family car, there are serious safety performance failures such as cracking of the body, failure of the braking system, failure of the steering system, and fuel leakage due to product quality problems. Sellers should return goods free of charge.

In response, several consumer representatives suggested extending the time limit. Consumer Representative Zheng Jisheng said: "How do you define the time of sale? Is it the date of the invoice or the date of shipment? Or does it start on the day when the consumer receives the car? I suggest defining the time for licensing and extending the time. ”

The representative hopes to set early arrival. In recent years, disputes over the quality of cars and maintenance services in China have increased significantly. Not only do consumers expect the introduction of the "Three Guarantees" regulation for cars, but representatives of manufacturers and dealers also called for the introduction of "Three Guarantees" for automobiles as soon as possible.

There are also representatives of dealers suggesting that a period of transition should be reserved when the automobile three-bag policy is introduced. "We need a little time to formulate rules and regulations so that we can make connections with manufacturers."
